A LAW to confer power on the National Trust for Jersey to enter into binding agreements restricting the use of land, sanctioned by Order of Her Majesty in Council of the

         WHEREAS the National Trust for Jersey (in this Law referred to as “the Trust”) was formed as an association not for profit and was incorporated by a Law passed by the States on 11th February, 1937, and confirmed by Order in Council dated 13th April, 1937;

         AND WHEREAS the Trust was established for the purpose of acquiring and preserving in the public interest land (including buildings) of historical interest or natural beauty and sites likely to disappear consequent on the construction of innumerable buildings throughout the Island;

         AND WHEREAS the Trust, with the generous support of landowners, donors, subscribers and others, has acquired by purchase, gift and otherwise, property, including lands and buildings, and funds for the upkeep and preservation thereof;

         AND WHEREAS better effect can be given to the purpose for which the Trust was established if the Trust were to be empowered to enter into binding agreements restricting the use of land;

         AND WHEREAS this object can be more fully attained if the Law which follows were to be enacted;

         THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law:-

ARTICLE 1.

         In this Law, “development” and “use” have the same meanings as in the Island Planning (Jersey) Law, 1964.

ARTICLE 2.

         Where any person is willing to agree with the Trust that any land or any part thereof shall so far as his interest in the land enables him to bind it to be made subject either permanently or for a specified period to conditions restricting the development or use thereof in any manner, the Trust may if it thinks fit, by means of a registered contract, enter into an agreement with him or accept a covenant from him to that effect and shall have power to enforce such agreement or covenant against persons deriving title under him in the like manner and to the like extent as if the Trust were possessed of or entitled to or interested in adjacent land and as if the agreement or covenant had been and had been expressed to be entered into for the benefit of that adjacent land.

ARTICLE 3.

         This Law may be cited as the National Trust for Jersey Law, 1984.
